What is a trademark assignment?

A trademark right is a transferable property right. Ownership may pass through an agreement, inheritance, a court decision, compulsory execution, or another legal basis.

The transfer may take effect between the parties under their agreement or the relevant legal event. However, if the trademark assignment is not recorded with the Taiwan Intellectual Property Office, it generally cannot be asserted against a third party. Recordal keeps the public ownership record aligned with the transaction.

If the brand owns separate registrations for Chinese and English names, logos, or different classes, identify which related rights should move together. Transferring only one registration can leave an unintended gap in ownership.

The documents depend on whether the transfer is contractual, a gift, an inheritance, a merger, or another legal event. Start with the parties, the trademark schedule, and evidence supporting the transfer.

  • Trademark names and application or registration numbers
  • An assignment agreement or other evidence of transfer
  • Tax or legal documents required for a gift, inheritance, merger, or other specific event

What should be checked before the transfer?

Confirm the registered owner, protection term, and covered goods or services in the TIPO record. Check whether a licence, security interest, or other record already exists, because a recorded licence or security interest may continue after the assignment.

Also identify related registrations, pending matters, ownership inconsistencies, and upcoming renewal deadlines so the agreement, trademark transfer recordal, and future portfolio management remain coordinated.
