Why does company-name approval not create trademark rights?

The same wording can form part of a registered company name and also be used by another party as a source identifier. Trademark registrability depends on the mark, the listed goods or services, and the statutory grounds examined by the Taiwan Intellectual Property Office.

A business that plans to place its short name on packaging, storefronts, ecommerce listings, or advertising should review that use as a trademark rather than relying only on company registration.

The value of clearance increases before a brand commits to assets that are expensive to replace.

How does Taiwan's first-to-file principle affect timing?

Taiwan generally follows a first-to-file registration system, so filing dates can affect priority between applications. Once the core name and business scope are reasonably settled, clearance and filing should be included in the launch plan.

This does not mean filing every working name immediately. Confirm the core brand, the applicant, and the real goods or services before defining the filing scope.

What should the brand do next?

List the formal company name, the brand name customers will see, the logo, and the goods or services planned over the next one to three years. An initial search can then identify obvious earlier marks before the filing scope is settled.
